Porn Tones (porntones.com and associated services) is not the producer (primary or secondary, as defined under 18 U.S.C. § 2257 and its implementing regulations) of any visual depictions of actual sexually explicit conduct appearing on the Platform.

Our role with respect to such content is strictly limited to the electronic transmission, storage, retrieval, hosting, and/or formatting of material that is posted and controlled by third-party users on portions of the site under their direction and control.

Custodian of Records Requests

Any inquiries or demands concerning records required to be maintained under 18 U.S.C. § 2257 (and 28 C.F.R. Part 75) for content appearing on Porn Tones should be directed exclusively to the individual or entity that uploaded the material in question — i.e., the Verified Uploader, amateur performer, producer, studio, or account holder responsible for that specific content.

Age-Verification & Compliance Safeguards

Porn Tones enforces the following strict age-verification and compliance safeguards for all user-uploaded content:

• Every Verified Uploader must be at least 18 years of age (or the higher age of majority required in their jurisdiction) at the time of account creation.
• All Verified Uploaders undergo mandatory personal identity verification (including government-issued photo ID) before they are permitted to upload, share, distribute, or monetize any content on Porn Tones.

Before any content may be uploaded, Verified Uploaders are required to certify and provide evidence that:

• Every individual who appears in the content was at least 18 years of age (or the applicable higher age of majority in their jurisdiction) at the time the content was produced.
• Every individual who appears in the content gave free, voluntary, and informed consent to participate in the production of the material and to its subsequent distribution on Porn Tones.

As the producer (or secondary producer) of the content being uploaded, the Verified Uploader attests that they are in full compliance with the record-keeping obligations set forth in 18 U.S.C. § 2257 and 28 C.F.R. Part 75 (as amended) with respect to all content submitted to Porn Tones. They further agree to promptly furnish legible copies of all required age-verification records (including government-issued photo identification documents and associated forms/releases) upon any lawful request from Porn Tones or authorized government authorities.

The uploaded content does not violate Porn Tones’ Terms of Service or any incorporated policies, including but not limited to our:

• Child Sexual Abuse Material Policy
• Non-Consensual Content Policy
• Revenge/Intimate-Image Abuse Policy
• And all other community guidelines and prohibited-content rules

Failure to comply with these requirements may result in immediate removal of content, suspension or permanent termination of the uploader’s account, withholding of any earnings, and reporting to appropriate law enforcement agencies where required by law.
