Our Approach to Copyright Complaints

Porn Tones takes allegations of copyright infringement very seriously.

We will respond to valid copyright infringement notices that comply with the requirements of the Digital Millennium Copyright Act (DMCA) or other applicable copyright laws.

Possible actions we may take after receiving a valid notice include:

• Removing the reported content
• Blocking access to it
• Disabling the content
• Terminating or suspending the account of the user who uploaded it
• Any combination of the above

Who Can Submit a Copyright Complaint?

Only the copyright owner or a person legally authorized to act on the copyright owner’s behalf may submit a copyright infringement notification.

How to Submit a Copyright Infringement Notice (DMCA Takedown Request)

Alternative method – Free-form written notice

You may also send a written DMCA notice by email.

In order to be legally effective under the DMCA, your notice must contain all of the following elements:

1. Clear identification of the original copyrighted work you claim has been infringed (or — if multiple works are involved — a representative list of those works)
2. Clear identification of the exact material you claim is infringing
   → Best practice: include the direct URL of each video/page you are reporting
   (General descriptions, usernames, channel names, titles alone are usually not sufficient)
3. Your contact information so we can reach you:
   • Full legal name
   • Physical mailing address
   • Telephone number
   • Email address
4. The following two mandatory statements:

   “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

   “The information in this notification is accurate, and under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the exclusive right that is allegedly infringed.”

5. Your physical or electronic signature
   (typing your full legal name is usually accepted as an electronic signature)

Counter-Notification Procedure

(If your content was removed and you believe it was removed by mistake)

If your content was removed or disabled following a DMCA notice and you believe it was removed or disabled by mistake or misidentification, you may send us a Counter Notice.

Counter Notice must contain:

1. Your full name, physical address, phone number and electronic or physical signature
2. Identification of the material that was removed + the exact URL where it was located before removal
3. The following two mandatory statements:

   “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”

   “I consent to the jurisdiction of the Federal District Court for the district in which my address is located (or if my address is outside the United States, for any judicial district in which the service provider may be found), and I will accept service of process from the person who provided the original notification under DMCA subsection (c)(1)(C) or an agent of such person.”

Send Counter Notice to the same Copyright Agent (same email or mailing address listed above).

After we receive a proper Counter Notice:

• We will forward it to the person who filed the original DMCA Notice
• We will generally restore the content 10–14 business days after receiving the Counter Notice unless the original complainant notifies us that they have filed a court case against you

Important: By sending a Counter Notice you consent that we may forward your Counter Notice (including your name and contact information) to the original complainant.

Repeat Infringers Policy

We reserve the right — in appropriate circumstances — to:

• Terminate accounts
• Permanently disable uploading privileges
• Block access to the platform

…of users we determine are repeat copyright infringers, whether or not there is a formal court order.

We may also take these actions against any user who — in our reasonable judgment — infringes the intellectual property rights of others.

Content Recognition / Fingerprinting Technology

We use automated content identification technology (audiovisual fingerprinting) to help prevent the upload of material that matches known copyrighted works.
